Tips and Tricks to Protect Yourself

Given that some couples who have faced cases of fraud in their former surrogacy or egg donation programs have recently contacted Parents Life, we would like to share with our intended parents the ways they can protect themselves. Namely, you should pay attention to the following aspects while choosing your surrogacy agency and/or IVF clinic:

  1. In case of a gestational surrogacy – you must ALWAYS be able to meet your prospective surrogate prior the start of your surrogacy program. You must always sign the direct surrogacy agreement with a surrogate of your choice in the presence of a notary prior to the start of a surrogacy program (as required by the Article 6, Paragraph 6.11 of the Order No. 787 of the Ministry of Health of Ukraine “On the use of assisted reproductive technologies in Ukraine” (The original text of the Order can be found on the website of the Ukrainian Parliament: Order No. 787)); NB: The IVF clinic always requests a copy of the surrogacy agreement signed;
  2. You should be able to perform a DNA test in a Lab of your choice (obviously, not linked to the IVF clinic) to ensure that there is no DNA linkage between a surrogate and a newborn. The question there is not only to prove the genetic linkage between the intended father and the newborn, but also to prove the absence of such a linkage between a surrogate and the newborn. This will help you to avoid a situation where a surrogate is inseminated directly (by means of IUI) without the use of egg cells donor or your own eggs (in order to save costs) – which is ABSOLUTELY illegal in Ukraine;
  3. In case of egg donation – a surrogacy agency and/or IVF clinic must ensure that all eggs retrieved will be your property and can be exported to your home country or cryopreserved in Ukraine for future use. In case of future use (to have a second child, for instance), the IVF clinic will be held accountable if a DNA test shows that the children from the two attempts are not genetically related. This will help ensure they give you a dedicated egg cells donor, matched for you and do not use any eggs or embryos from their cryopreservation storage facilities that happen to be available.

Currently, we suspect some market players that could resort to such immoral and illegal practices of doing business. If in your selection process you control the aforementioned topics, you can protect yourself!
