Introduction to Surrogate Motherhood

Surrogate motherhood is, perhaps, the best example of a complex and reproductively unusual arrangement that separates motherhood from social motherhood. Progress in assisted reproductive technologies (ART) causes many social, psychological, medical and legal issues. These issues need to be addressed in the sociocultural context in which this occurs. Psychological factors need to be studied and recognized in order to determine the attractiveness of surrogate motherhood, as it is today in Ukraine and throughout the world. Public opinion does not always favor surrogate mothers as a suitable option for infertile women, unable to bear the child to term.

Over the years, several inquiries and committees have been set up, consisting of many reputable individuals who are discussing the need or against legislation within an arrangement in which three or more parties involved. Other influential bodies, such as the Ministry of Healthcare of Ukraine, recognized the inevitable practice of surrogate motherhood and issued new guidelines for good practice and support for those involved in the treatment of patients as from Ukraine as from abroad. However, despite the documentation provided by these authorities, there is little information on surrogate motherhood, in particular evidence of the long-term consequences for the intended parents (mother or father) and surrogate mothers (the mother carrying and delivering the child), and on the long-term consequences of these a variety of arrangements upon the resultant offspring and wider family network.

Available studies and other media comments on surrogate motherhood from the moral, ethical, legal, philosophical, social and psychological points of view either justify or condemn the practice. Confronted with shameful and condemning views from the opposite feminist, ethical, human rights and legal prerequisites. All prospects agree that selective “inbreeding” and the exploitation and commodification of the purchase of a child are unacceptable. No one can even try to understand the meaning of these rights for different people. These rights should be interpreted in the context of a person’s age, marital status, economic and social conditions, religious and ethical identity and stage in their life cycle. Thus, reproductive and sexual rights may not have universal applicability; they can change their meaning throughout their lives. There is also concern about the adoption of rights. If these rights are related to human freedom, then they are essential. If these rights relate to meeting the need for desire (for example, the child in cases of intended parents and money in the surrogate mother cases), these rights may need to be assessed.

The satisfaction of the rights of the commissioned offspring who may not know that the donated gametes and/or surrogates, contracts and money were used in their concept may be even more difficult. If no harm has been done or the intention to do harm is not a fundamental principle underlying these rights, they can also assume a society of acceptability.
