Gestational carrier (Surrogate)

A gestational carrier, involved in the process known as a “gestational surrogacy”, is a woman who is delivering a newborn baby who is not genetically linked with her. The intent of a surrogate conceiving a child is to enable a couple that cannot have a child to have finally one who is genetically linked with them. You should differentiate a gestational carrier from what is known as a “traditional carrier”. In a “traditional surrogacy”, which is not permitted in Ukraine by the Ukrainian law, a traditional carrier is inseminated with sperm and delivers a newborn baby who is genetically hers. An opposed situation is with a gestational carrier, who delivers a newborn baby who is not genetically linked with her.

Whether the use of a surrogate is an ethical practice is certainly a contentious issue. Experts of using a surrogate reason some concerns regarding reproductive autonomy, commodifying woman and their reproductive functions, baby-selling, coercion, exploitation of lower socioeconomic classes, insufficiently informed consent and effect on the household.

However, after closer inspection of all above arguments, it is apparent that the concept of utilizing a gestational carrier, in general, is definitely an ethically justifiable and, actually, needed technology for infertile women/couples. Safeguards to protect a gestational carrier from coercion, taking into account her vulnerability when it comes to sources of increasing her income, and acknowledging the emotional difficulty in giving a child up after birth should be in place for the ethical way of using a surrogate.

A gestational carrier must formerly have her own child and be correctly screened psychologically. She should receive information about the risks of pregnancy, and know her legal rights from a surrogacy agreement and options apart from surrogacy to receive monetary compensation. She should consult a physician and a lawyer in addition to the contracting person/couple and surrogacy agency. With these safeguards in place, concerns with the ethical suitability of utilizing a gestational carrier could be resolved, and this useful practice can continue as a strategy in infertility treatment.
